Terms of Use of the Innovation Week Webservices

  1. Scope of Application
    • The following Terms of Use by Heidelberger Druckmaschinen AG, Kurfürsten-Anlage 52-60, 69115 Heidelberg, Germany ("Heidelberg") apply to the use of the Heidelberg Innovation Week website and services offered via this website (all together the "Service"). By accepting these conditions, the natural person who uses the Service ("User") enters into a binding agreement with Heidelberg.
  2. The Service
    1. The Service is performed in the context of the event Heidelberg Innovation Week and enables Users to access various contents and information about Heidelberg, Heidelberg's products and more.
    2. In particular the Service consists of the following components:
      • Access to information about Heidelberg's products and the event Innovation Week
      • The possibility to make appointments with Heidelberg specialists to hold one on one meetings via Microsoft Teams on selected topics
      • Registering for specific components of the events
      • Access to live and on-demand videos which are provided via YouTube
      • Access to expert talks including the possibility for User to get answers to individual questions in a moderated group-chat
      • Access to live-chats on specific topics or to answer individual questions
      • Personalized customer care: Each User will receive a daily summary massage regarding his participation in the Innovation Week containing further information tailored to the interests of the User. To be able to provide this service, Heidelberg and its service providers (such as Google or Mailjet) need to gain, store and process User's personal data regarding his use of the Service.
    3. The announcement of and registration for events, talks, chats or similar via the Service does not entitle the User to claim access to such services or or create any obligation of Heidelberg. In no event shall Heidelberg be obliged to provide a specific piece of content (such as a specific video) to the User, even if this specific piece of content was promoted, in a preview, or similar.
    4. Heidelberg reserves the right to deactivate the Service or part thereof for security reasons (e. g. security vulnerabilities) or other important reasons.
    5. Using the Service requires registering with an account provided by Heidelberg. The User will be forwarded to log in or register with said account where and as far as required
    6. In view of the current state of technology, the provision and use of the Service may be subject to restrictions that are beyond Heidelberg's ability to influence. In particular, this relates to the availability of mobile data connections provided by mobile operators, the mobile network and Internet access. Thus the Service is spatially limited to the reception and transmission zones covered by the mobile stations managed by the relevant mobile operator. In certain cases, the non-availability of the mobile network may result in the unavailability of individual services because the necessary data transfers cannot take place. Short-term capacity bottlenecks may also result from peak loads on services, mobile and fixed networks, and the Internet. Furthermore, disruptions may arise for reasons of force majeure including strikes, lockouts, epidemics, pandemics and government decrees, as well as technical and other measures (e. g. repairs, maintenance, updates, upgrades) that take place at Heidelberg facilities or those of any upstream and downstream service providers, content providers and network operators that may be required for the proper or improved provision of the services.
    7. Heidelberg reserves the right to make amendments and additions to the Terms of Use if they benefit the User or are deemed acceptable to the User while taking Heidelberg's interests into account. In particular, Heidelberg reserves the right to extend the functionality of the services and add new services at any time and to amend or supplement the Terms of Use accordingly.
  3. User Obligations
    1. To be able to use the Service, the User requires a compatible device.
    2. The user will comply with all applicable laws and regulations while using the Service.
    3. User undertakes not to perform any actions that violate the rights of other persons or impair the availability or appearance of the Service.
  4. Term and Termination
    • The agreement to use the Service is concluded for an indefinite term. User has the right to terminate the agreement at any time with immediate effect. Heidelberg has the right to terminate the agreement without cause at any time with 30 days' notice. Heidelberg may terminate the agreement for cause at any time without prior notice, which cause may lay in the violation of any of the present terms by the User.
  5. Fees and Costs
    1. There is no fee for using the Service.
    2. The User shall bear the cost of any data connections required to access the Service via a compatible device or other transmission media and telecommunications equipment and shall be subject to the tariffs charged by the relevant provider chosen by the User.
  6. Intellectual property rights
    1. Heidelberg grants the User a non-exclusive license to use the Service within the term of this agreement for the User's own purposes. This license does not include the right to alter, distribute or sub-license the Service in any way.
    2. The content and layout of the contents provided as a part of the Service are protected by copyright. The storage and reproduction of texts, images, video files, audio files or graphics is not permitted unless expressly approved in writing in advance. Only expressly authorized information that has been made available for download by reference to a specific source is excluded from this provision.
  7. Warranty
    • The use of the Service is at the User's own risk and any services are provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied. Neither Heidelberg or any person or company associated with Heidelberg makes any warranty or representation with respect to the completeness, security, reliability, quality, accuracy, or availability of the services. With the fullest extent provided by law, Heidelberg hereby disclaims all warranties of any kind whether express or implied, statutory, or otherwise, including but not limited to any warranties of non-infringement and fitness for particular purpose.
  8. Liability
    1. In the event of injury to life, limb or health, based on a willful or negligent breach of duty by Heidelberg or one of its legal representatives or vicarious agents, Heidelberg shall be liable under the legal provisions. The following subsections apply for other damages.
    2. For damage that is based on a willful or grossly negligent breach of duty by Heidelberg or one of its legal representatives or vicarious agents, Heidelberg shall be liable under the legal provisions.
    3. For damage that is based on the breach of material contractual duties (obligations where their fulfillment is essential for enabling the contract to be properly executed and where the customer regularly relies or can regularly rely on their fulfillment) as a consequence of simple negligence by Heidelberg or its legal representatives or vicarious agents, the liability of Heidelberg is limited to the foreseeable damage that is typical of this kind of contract.
    4. Claims for other damage based on the breach of ancillary duties or non-material duties in the case of minor negligence are excluded.
    5. Claims for compensation of damages arising from default that are based on simple negligence are excluded; this is without prejudice to the legal rights of the customer after a reasonable grace period has ended.
    6. Heidelberg is not liable for indirect or direct damage resulting from defective delivery objects, such as downtimes, loss of production, lost profit, and additional consumption of materials, damage to or loss of data.
    7. The exclusions or limitations of liability do not apply if Heidelberg fraudulently conceals a defect or has assumed a warranty for the properties of the delivery objects.
  9. Privacy
    1. The use of the Service is subject to the Innovation Week privacy policy.
    2. Heidelberg may process the data and usage behavior in anonymized form for the purpose of tailoring the services to suit requirements.
    3. Heidelberg is interested in protecting user data and therefore uses technical and organizational security measures to protect the User's information and data against manipulation, loss, unauthorized disclosure and access by unauthorized third parties. Heidelberg shall regularly review these technical and organizational measures and continuously improve them in line with technological developments.
  10. Compliance
    1. The User undertakes to take all necessary and appropriate measures to avoid corruption and other criminal offences.
    2. By using the Service, the user confirms that the usage of the Service is in accordance with the compliance requirements of his company and that any necessary approvals have been obtained.
  11. Final Provisions
    1. Where the User is a merchant, legal person under public law, or special assets (Sondervermögen) under public law or has no legal venue in Germany, Heidelberg (Germany) will be the exclusive venue for any disputes arising out of or in connection with these terms. Any mandatory venue rules will remain unaffected hereof.
    2. The relationship existing between the User and Heidelberg shall be governed by the laws of the Federal Republic of Germany, with exception of mandatory consumer protection laws of the jurisdiction of the User's usual place of residence where the User uses the Service for purposes that are outside his/her trade or profession..
    3. Heidelberg may assign any right or delegate any duty under this agreement without Users consent to any company that is affiliated with Heidelberg within the meaning of section 15 German Stock Corporation Act (Aktiengesetz).
    4. If any term of these terms and conditions becomes invalid in total or in parts, this shall have not have any effect on the validity of the remaining terms of these terms and conditions.
